September 11, 2025Dear Clients & Friends, Transportation companies have been chronically neglecting to include proper information on their electronic manifests (ACE manifest). When a shipment is consolidated with two or more entries created by the U.S. Customs House Broker, it is IMPERATIVE the transport includes ALL entries on their ACE manifest. Failing to do so causes an enormous issue with CBP and an extensive amount of extra work for us to resolve the issue on our clients’ behalf. The entry that failed to be included is left without a release and is classified as “unmanifested goods” by CBP which is highly prohibited. Currently CBP has been releasing the entries with proof of documentation that our team has to compile and submit in a time sensitive manner and has been fining the Importer or Record since they cannot collect directly from the transportation companies. Since this matter has been ongoing and continues to occur, CBP is now looking to take more aggressive actions and request redelivery of the cargo to the port of entry on top of issuing a fine. If the product has already been shipped and moved from the local warehouse, CBP will more than likely request a redelivery no matter the location of the goods. If the product cannot be redelivered, the fines can amount to three times the commercial value of the load. This also puts the importers bond at risk for future importations. We would like to reiterate that the communication between the shipper and the carrier is critical to avoid these situations from reoccurring. It is the transportation company’s sole responsibility to know exactly what they are carrying in their trailer, and to ensure they list the accurate and COMPLETE information on their ACE manifest. We highly recommend for all shippers to notify their transport companies when shipments will be consolidated. As previously stated, CBP will begin to request redeliveries when this occurs. We encourage for all importers to review our tracking system when a shipment has been offloaded at their warehouse. If the warehouse personnel sees that the load does not have an electronic release by CBP, please hold the product at the warehouse and contact us immediately; we will try to rectify the issue with CBP before the product has been moved or sold.Unfortunately, due to the extensive amount of additional work and time it takes our team to tend to these cases, we will begin charging a fee of $500.00 USD for every case we have to file with CBP effective immediately!
