March 12, 2026| Dear Clients & Friends, Below please find the notice we received from our friends at the FPAA. If you are not an FPAA member and are interested in participating, please contact the FPAA directly. Thank you, From: Lance Jungmeyer Sent: Wednesday, March 4, 2026 3:52 PM Subject: Court of International Trade orders refunds on IEEPA Tariffs Dear Members of the FPAA, As you know, the FPAA has been monitoring and advocating for your interests in the IEEPA tariffs. FPAA previously filed a lawsuit asking the Federal Government to refund the IEEPA tariffs that FPAA members have paid. We are pleased to report that the Court of International Trade has rule in favor of FPAA’s position, and the Court has ordered US Customs and Border Protection to begin issuing refunds. Here is an article: https://thehill.com/homenews/5767822-federal-trade-court-ruling/ While this is great news, it may be some time before you are able to claim your company’s refunds. It is widely expected that this decision will be appealed by the Trump Administration, and therefore it is unclear how long CBP will hold on to the tariffs. We will be awaiting further guidance from FPAA’s Customs Attorney. Please watch for details. Sincerely, Lance Jungmeyer President FPAA PS – If your company did not yet sign on to the FPAA lawsuit, we encourage you to add your name, as this might be beneficial to you if CBP fails to issue refunds automatically. Please contact amoore@thefpaa.com to add your company to the lawsuit. |
