| Upcoming IEEPA Refunds – How to Prepare Dear Clients & Friends, We hope you are doing well. We wanted to share a quick update regarding the upcoming refund process for duties paid under the International Emergency Economic Powers Act (IEEPA). As you may have heard, these tariffs have been struck down, and companies that paid these duties between 2025 and early 2026 are expected to be eligible for refunds. While details are still being finalized, the process is expected to take place within ACE through a platform called CAPE, with refunds likely issued electronically. Please note: The CAPE platform will not be available through your customs broker’s ACE software. It will only be accessible through your company’s ACE Secure Data Portal account. To help you prepare ahead of time, we recommend reviewing the following: Make sure your ACE Secure Data Portal account is active Confirm your CBP Form 5106 information is up to date Review your ACH Refund Authorization in ACE to ensure your banking details are complete and accurate Verify the bank account listed is a U.S. account ready to receive ACH deposits Please keep in mind that receiving refunds through ACH is set up separately from how duties and fees are paid, so it’s worth double-checking even if you already pay CBP electronically. For your convenience, here are a few helpful resources: CBP Declaration (CAPE): CAPE ACH Refund Information: https://www.cbp.gov/trade/automated/ach/refund How to Apply for an ACE Portal Account: https://www.cbp.gov/trade/automated/how-to-use-ace/portal-applying Setting Up ACH for Refunds in ACE: https://www.cbp.gov/document/ CBP is expected to provide additional guidance on March 31st regarding how to submit refund requests. This will be the first step in the process, and actual refunds may be issued at a later date. We will continue to monitor updates and keep you informed. Kindest regards, |
